Consumers should be on alert for fraud during holidays

Jefferson City, Mo. — Attorney General Jay Nixon urges consumers to be extra cautious during the holidays. Scam artists target consumers who may be unaware of their rights under federal and state laws. Scam artists also rip off consumers through charity fraud, easy-money opportunities and mail order shopping.

"An alert shopper is a smart shopper," Nixon said. "Consumers have certain rights under federal and state laws that can prevent unnecessary headaches during the gift-giving season."

He encourages consumers to be aware of their rights when:

  • Giving to charities. While most charities are honest, some pocket most of the money they solicit. Avoid donating to a fraudulent charity. Ask questions about the organization, how your money will be spent and if they are registered with the Attorney General's Office. Most charities and professional fund-raisers are required to register.
  • Shopping. Many shoppers falsely believe stores must offer refunds. However, there is no state law on refund or layaway policies. Stores set their own policies and may offer a cash refund, credit, exchange or nothing.
  • Mail ordering. The Attorney General's Office receives complaints each year about exaggerated claims by mail order companies or slow of nondelivery of ordered items. Get all promises and delivery dates in writing. This is your protection for getting money back on products that are misrepresented or not delivered as promised.
  • Earning extra money. Beware of business opportunities that offer extra money during the holidays. Consumers who want to invest in a business opportunity should avoid offers that promise a huge income potential with little or no work in a short time. Get all promises in writing and signed by an authorized agent of the company. Don't be misled by testimonials.
