Jackson County roofer pleads guilty to unlawful merchandising practices

Independence, Mo. — A Jackson County roofer pleaded guilty yesterday to two criminal counts of unlawful merchandising practices brought by Attorney General Jay Nixon.

John Howard Ray (DOB - 9/30/56), who did business under the name Noah's Ark Roofing/Repair, contracted with several Kansas City area residents and churches in 1996 to provide roofing work. He took down payments of up to $6,940 for services and supplies, but failed to perform any work.

Ray faces a punishment of up to 10 years imprisonment and a fine of up to $20,000. Sentencing is scheduled for August 13.

"This latest conviction is just one of many we have obtained against contractors that have ripped-off Missouri property owners," Nixon said. "We will continue to prosecute these frauds."

Nixon said there are several precautions consumers can take to avoid home repair fraud:

  • Obtain written estimates from at least three local contractors. Ask for an address and phone number if the workers tell you they are self-employed.
  • Get all guarantees in writing. Ask for the names of references and call them.
  • Don't pay for the entire job with your down payment. The down payment should be no more than one-third of the total price.
  • Should a contractor ask for an advance on supplies, consider writing the check directly to the supplier.
  • Call your local Better Business Bureau to check on complaints or the Attorney General's Consumer Protection Hotline at 800-392-8222 to check on legal action against a contractor.
